1. Services

The Company provides software-as-a-service (SaaS), software development, automation, design, consulting, digital products, and related services.

Services may be modified, updated, suspended, or discontinued at any time.

2. Eligibility

You must be at least 18 years old and authorized to enter a binding agreement.

3. User Accounts

You agree to provide accurate information and maintain security of account credentials.

You are responsible for activity under your account.

4. Acceptable Use

You agree not to:

• Violate law
• Misuse or disrupt the Services
• Attempt unauthorized access
• Upload malicious code
• Reverse engineer or exploit Services without authorization
• Use Services for fraudulent or unlawful purposes

5. Customer Content

You retain ownership of content you submit.

You grant the Company a limited right to host, process, store, and use content as reasonably necessary to provide Services, including support by affiliated entities where applicable.

6. Intellectual Property

All software, code, branding, content, and related materials are owned by DM Studios AI, LLC, Send A DM, LLC, Fate Studios Creative, LLC, or their licensors.

No rights are granted except as expressly authorized.

7. Fees and Payments

Paid services are subject to agreed fees and billing terms.

Nonpayment may result in suspension.

Subscription services may renew automatically unless canceled.

8. Third-Party and Affiliate Services

Services may include integrations, subcontracted services, or operational support involving third parties or affiliated entities, including Fate Studios Creative, LLC.

We are not responsible for independent third-party services outside our control.

9. Privacy

Use of the Services is subject to the Privacy Policy.

10. Disclaimer of Warranties

To the maximum extent permitted by law, services are provided “as is” and “as available,” without warranties of any kind.

11. Limitation of Liability

To the maximum extent permitted by law, DM Studios AI, LLC, Send A DM, LLC, Fate Studios Creative, LLC, and their affiliates shall not be liable for indirect, incidental, consequential, or special damages. Total liability shall not exceed amounts paid by you to the Company during the prior twelve (12) months.

12. Indemnification

You agree to indemnify and hold harmless DM Studios AI, LLC, Send A DM, LLC, and Fate Studios Creative, LLC from claims arising from:

• Your use of Services
• Your content
• Your breach of these Terms
• Your violation of law or third-party rights

13. Termination

We may suspend or terminate access for violations of these Terms or protection of the Services.

14. Governing Law

These Terms are governed by California law.

15. Dispute Resolution

Disputes shall first be addressed informally.

If unresolved, disputes may be resolved by binding arbitration in California, except where prohibited by law.

16. Changes to Terms

We may revise these Terms at any time. Continued use constitutes acceptance of updated Terms.

These Terms, related service agreements, and incorporated policies constitute the entire agreement.
